These Terms of Service ("Terms") govern your use of the Mailm8 software ("Software") provided by Boshoff Technology Service Solutions Pty Ltd, Registration Number 2022 / 002671 / 07 ("Company", "we", "us", or "our"), a company registered in South Africa.
By downloading, installing, or using the Software, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Software.
We offer a 14-day free trial license that allows you to evaluate the Software. The trial license is limited to the features specified at the time of download and may not include all Pro features.
Upon payment of the applicable license fee, we grant you a non-exclusive, non-transferable, limited license to use the Software in accordance with these Terms and the license tier you have purchased (Pro Monthly or Pro Annual).

Current pricing is available on our Pricing page. All prices are in South African Rand (ZAR) and include VAT where applicable.
Payments are processed securely through PayFast, a registered payment service provider in South Africa. We do not store your payment card details.
For subscription-based licenses (Pro Monthly), your payment method will be charged automatically at the beginning of each billing cycle until you cancel.
We offer refunds within 30 days of purchase if you are not satisfied with the Software. To request a refund, contact us at the email address provided in our Contact page. Trial licenses are not eligible for refunds as they are provided free of charge.
Your use of the Software is subject to our Privacy Policy, which complies with the Protection of Personal Information Act (POPIA), Act No. 4 of 2013. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.
The Software, including all source code, documentation, and related materials, is protected by copyright and other intellectual property laws. We retain all rights, title, and interest in and to the Software.
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED.
TO THE MAXIMUM EXTENT PERMITTED BY SOUTH AFRICAN LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE 12 MONTHS PRECEDING THE CLAIM.
You may terminate your license at any time by ceasing to use the Software and uninstalling it from all devices.
We may terminate your license immediately if you breach these Terms. Upon termination, you must cease all use of the Software and uninstall it from all devices.
Upon termination, all rights granted to you under these Terms will immediately cease. Sections 5, 6, 7, 9, and 10 shall survive termination.
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Effective Date" above. Your continued use of the Software after such changes constitutes your acceptance of the new Terms.
